Use of our services
Social Analytics provides healthcare analytics and insights services to pharmaceutical, biotech, and healthcare organisations. Your use of these services is conditional on your agreement to these terms and your compliance with all applicable regulations, including those governing healthcare data, privacy, and therapeutic goods.
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair Social Analytics or interfere with others' use and enjoyment of our services. This includes but is not limited to attempting to gain unauthorised access to our systems, reverse-engineering our methodologies, or using our insights in violation of applicable law.
Intellectual property
All content, reports, analyses, methodologies, and materials provided by Social Analytics remain our intellectual property unless otherwise stated in a written agreement. You may not reproduce, distribute, modify, or transmit any materials without our prior written consent, except as necessary for your internal business purposes as permitted by your engagement agreement.
Data and confidentiality
Social Analytics handles aggregated, anonymised data in accordance with applicable privacy legislation, including the Privacy Act 1988 (Cth) and relevant healthcare regulations. We maintain strict confidentiality of client information and do not disclose your identity or engagement details without your consent, except as required by law.
You agree to maintain the confidentiality of any insights, reports, or information provided to you by Social Analytics. These materials are prepared for your exclusive use and should not be shared with third parties without our written permission.
Liability and disclaimers
Our insights and forecasts are based on available data, established methodologies, and reasonable assumptions at the time of analysis. We do not guarantee the accuracy, completeness, or fitness of our analyses for any particular purpose. Market conditions, regulatory environments, and patient behaviour can change unexpectedly, and past patterns do not guarantee future outcomes.
To the fullest extent permitted by law, Social Analytics excludes all warranties, express or implied, including merchantability and fitness for a particular purpose. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, even if advised of the possibility of such damages.
Termination
Either party may terminate an engagement in accordance with the terms of the specific engagement agreement. Upon termination, your right to use our services and access our materials ceases immediately. Provisions regarding confidentiality, intellectual property, and liability survive termination.
Governing law
These terms are governed by the laws of Australia and are subject to the exclusive jurisdiction of the Australian courts. Any dispute arising from these terms or your use of Social Analytics services will be resolved in accordance with Australian law.
